Welcome to WareforPA.com (the “Site”). This Site is operated by Zachary Ware and Friends of Zachary Ware (the “Campaign,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Site.
1. Purpose of Site
This Site is provided for general informational and campaign-related purposes, including sharing information about Zachary Ware’s campaign for public office, collecting messages from supporters and members of the public, and offering ways to receive campaign updates.
2. Eligibility
The Site is intended for users who are 13 years of age or older. If you are under 13, please do not use the Site or submit personal information through it.
3. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Site, you consent to the data practices described in the Privacy Policy.
4. Intellectual Property
Unless otherwise noted, all content on this Site (including text, graphics, logos, photographs, videos, audio, page design, and other materials (collectively, “Content”)) is owned by or licensed to the Campaign and is protected by intellectual property laws.
Limited permission
You may view, download, and print Content for personal, noncommercial use and you may share links to the Site. You may not:
- reproduce, modify, distribute, publicly display, or create derivative works from the Content for commercial purposes, or
- use our name, logos, or branding in a way that suggests endorsement or affiliation without our prior written permission.
5. User Submissions
If you submit a message, form, or other information through the Site (“Submission”):
- You represent that the information you provide is accurate to the best of your knowledge.
- You agree not to submit unlawful, threatening, harassing, defamatory, obscene, or otherwise harmful content.
- You understand that messages sent through the Site are not confidential.
Permission to use Submissions
You grant the Campaign permission to use your Submission for campaign-related purposes, such as responding to you, improving our operations, understanding what issues matter to constituents, and internal recordkeeping. We will handle personal information in accordance with our Privacy Policy.
6. Email Updates
If you choose to sign up for email updates, you agree that we may send you campaign-related emails.
- Opt-out: You can unsubscribe at any time by clicking the unsubscribe link in any campaign email.
- No guarantee: We do not guarantee any particular frequency of emails.
7. Donations and Third-Party Payment Processing
The Campaign may provide links to third-party services that process political contributions, such as ActBlue.
- Third-party terms: If you click a donation link and contribute through a third-party platform, your contribution is processed by that third party and is subject to their terms and privacy practices.
- No control: We do not control third-party websites or services and are not responsible for their availability, security, or practices.
- Future changes: We may change donation processors or methods in the future (including embedding a donation form on the Site). If we do, these Terms and/or our Privacy Policy may be updated.
Note: Political contributions are generally not tax-deductible.
8. Third-Party Links
The Site may include links to third-party websites or resources (including news articles, community resources, social platforms, and donation services). These links are provided for convenience only. We do not endorse and are not responsible for the content, products, services, or practices of third parties.
9. Acceptable Use
You agree not to:
- attempt to gain unauthorized access to the Site or related systems,
- interfere with the Site’s operation or security,
- use automated means (bots, scrapers, spiders) to access or collect data from the Site without our permission,
- upload or transmit malware or other harmful code,
- use the Site to harass, threaten, impersonate, or harm others,
- use the Site in any manner that violates any applicable law or regulation.
We may suspend or block access to the Site (in whole or in part) at any time if we believe these Terms have been violated.
10. Disclaimers
10.1 Site provided “as is”
The Site and Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 No professional advice
Nothing on this Site constitutes legal, medical, financial, or other professional advice. You should consult appropriate professionals for advice specific to your situation.
11. Limitation of Liability
To the maximum extent permitted by law, the Campaign and its officers, volunteers, agents, and service providers will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.
If, notwithstanding the above, we are found liable for any loss or damage arising from your use of the Site, our liability will not exceed $100.
(Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the fullest extent permitted by law.)
12. Indemnification
You agree to indemnify and hold harmless the Campaign and its officers, volunteers, agents, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use of the Site,
- your violation of these Terms, or
- your violation of any rights of another person or entity.
13. Changes to the Site and Terms
We may update the Site and these Terms at any time. When we update these Terms, we will revise the “Last updated” date at the top. By continuing to use the Site after changes become effective, you agree to the updated Terms.
14. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in state or federal courts located in Pennsylvania, and you consent to personal jurisdiction in those courts.
15. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
